Little Fins Swim School (“Little Fins,” “we,” “us,” or “our”) operates swim instruction programs at two Colorado Springs locations. By enrolling in lessons, accessing our website at littlefinsswimschool.com, or using our booking system, you (“parent,” “guardian,” or “client”) agree to the following terms and conditions. 1. Services

Little Fins Swim School provides private one-on-one and Pod swim lessons, as well as specialty programs, for swimmers from 6 months through adulthood at our two Colorado Springs locations:

• Union Boulevard / Medical Campus: 1625 Medical Center Point, Suite 160, Colorado Springs, CO

Program availability, scheduling, and pricing are subject to change. Current offerings and available times are reflected in our booking system (Pike13).

2. Enrollment and Booking

Enrollment is completed through our online booking platform (Pike13). By completing enrollment, you confirm that:

• You are the parent or legal guardian of the enrolling swimmer, or are an adult enrolling on your own behalf.
• All information provided during enrollment is accurate and complete.
• You have reviewed and agree to these Terms and Conditions.
• Little Fins reserves the right to decline or discontinue enrollment at its discretion.

3. Health and Medical Disclosures

For the safety of all swimmers and instructors, you agree to disclose any relevant health conditions, developmental considerations, physical limitations, or medical history that may affect participation in lessons. This information will be used solely to provide appropriate instruction and will be kept confidential.

You acknowledge that swim lessons involve physical activity in an aquatic environment. By enrolling, you confirm that the swimmer is physically able to participate and that you have consulted a healthcare provider if you have any concerns about participation.

4. Assumption of Risk and Waiver of Liability

Swimming and aquatic activities involve inherent risks, including the risk of physical injury. By enrolling in lessons at Little Fins Swim School, you acknowledge and accept these risks.

To the fullest extent permitted by applicable law, you release and hold harmless Little Fins Swim School, its owner, employees, instructors, and agents from any and all claims, damages, losses, or expenses arising out of or related to participation in lessons, including but not limited to injury, illness, or property damage — except in cases of gross negligence or willful misconduct.

5. Photography and Media

Occasionally, Little Fins may photograph or video-record lessons or events for use in marketing materials, social media, or internal training. If you do not consent to your child or yourself being photographed or recorded, please notify us in writing prior to your first lesson. We will honor all opt-out requests.

We will never sell images or footage to third parties or use them in a manner inconsistent with this disclosure.

6. Attendance and Cancellation Policy

We understand that schedules change. Our current cancellation and makeup policy is detailed in your enrollment agreement within Pike13. By enrolling, you agree to the cancellation terms in effect at the time of your enrollment.

General guidelines:

• Cancellations made within the required notice window are eligible for rescheduling.
• Late cancellations or no-shows may forfeit the lesson at Little Fins’ discretion.
• Little Fins reserves the right to cancel or reschedule lessons due to instructor availability, facility issues, or other circumstances beyond our control. In such cases, we will provide a makeup option or credit.
• Please refer to your Pike13 enrollment agreement for current timeframes and specific terms.

7. Payment Terms

Payment is processed through Pike13 at the time of enrollment or according to the payment plan selected during booking. All fees are clearly presented prior to checkout.

Package and lesson fees are non-refundable except where required by applicable law or at Little Fins’ sole discretion. If you have questions about payment or need to discuss your account, please contact us directly at (719) 344-5328.

8. Conduct Policy

Little Fins Swim School is committed to maintaining a safe, respectful environment for swimmers, families, and staff. We reserve the right to dismiss any participant, without refund, whose behavior endangers others or is disruptive to the learning environment. This applies to both swimmers and accompanying family members.

9. Website Use

By accessing littlefinsswimschool.com, you agree to use the Site for lawful purposes only. You may not use the Site in any way that could damage, disable, or impair its functionality, or interfere with any other user’s access. All content on the Site — including text, images, and program descriptions — is the property of Little Fins Swim School and may not be reproduced without written permission.

10. Intellectual Property

All content on the Little Fins Swim School website, including written content, logos, images, and program descriptions, is owned by Little Fins Swim School or its content providers and is protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or modification of any Site content is prohibited.

11. Disclaimer of Warranties

The information provided on our website and in our marketing materials is for general informational purposes. Little Fins Swim School makes no guarantees regarding specific skill outcomes, timelines, or results from participation in lessons. Progress varies by swimmer and is influenced by many individual factors.

Swim lessons are not a substitute for constant adult supervision around water. Parents and guardians remain responsible for their child’s water safety at all times outside of scheduled lessons.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Little Fins Swim School’s total liability to you for any claims arising from your use of the Site or participation in our programs shall not exceed the total amount paid by you for lessons in the 30 days preceding the claim.

13. Governing Law

These Terms and Conditions are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of El Paso County, Colorado.

14. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Material changes will be reflected by an updated Effective Date at the top of this page. Continued use of our Site or services following any changes constitutes your acceptance of the revised terms.
